HIPAA PRIVACY AUTHORIZATION

Patient Consent to Use and Disclose Health Information

Please read this document carefully before creating your MamaCare360 account.

By checking the HIPAA authorization box at sign-up, you confirm that you have read, understood, and agree to the terms below. This authorization is required to use MamaCare360.

 

1.  WHO WE ARE

MamaCare360 LLC is a web-based health monitoring platform for pregnant and postpartum women. We are a Business Associate under HIPAA — meaning we store and transmit your health data on behalf of you and your authorized healthcare providers. We do not provide medical diagnoses, clinical care, or insurance billing services.

 

2.  WHAT DATA WE COLLECT

When you use MamaCare360, we collect the health information you enter, which may include:

  • Mood, anxiety level, and sleep quality logs
  • Physical symptoms including blood pressure, blood glucose, weight, headache, and nausea
  • Feeding and breastfeeding logs
  • Edinburgh Postnatal Depression Scale and PHQ-9 screening responses
  • Menstrual cycle and ovulation data
  • Appointment records
  • Date and time of every entry

 

This information is collectively referred to as your Protected Health Information or PHI.

3.  HOW YOUR DATA IS USED

By creating an account and checking this authorization, you authorize MamaCare360 to:

  • Securely store your health logs on HIPAA-compliant, encrypted servers
  • Make your data visible to any healthcare provider you choose to connect with through MamaCare360
  • Generate downloadable summaries and reports of your health data for your own use or to share with your providers
  • Use de-identified, aggregated data (with all personal information removed) for quality improvement and research purposes — your name and identifying information will never appear in such reports

We will never sell your data. We will never share your data with any third party without your explicit consent, except as required by law.

4.  SHARING WITH YOUR AUTHORIZED PROVIDER

MamaCare360 allows you to share your health data with healthcare providers of your choosing — such as your doula, lactation consultant, pelvic floor therapist, or mental health provider. By authorizing a provider within the platform, you give that provider access to your relevant health logs.

Your responsibility when downloading or sharing.

When you download your health data or share it outside the MamaCare360 platform — including via email, text message, Google Drive, or any other method — you are solely responsible for safeguarding that information. MamaCare360 cannot control how downloaded data is stored, forwarded, or accessed once it leaves our platform.

Only share your health data with people you trust. Do not share download links publicly. MamaCare360 is not liable for any unauthorized access to data you have chosen to download or share.

5.  YOUR RIGHTS

Right to revoke

You may revoke this authorization at any time by emailing info@mamacare360.com. Revocation will not affect any actions already taken before we receive your request. Once revoked, your data will no longer be visible to connected providers.

Right to access

You have the right to download and review all health data you have entered into MamaCare360 at any time using the export feature.

Right to deletion

You may request deletion of your account and all associated health data by emailing info@mamacare360.com. Deletion is permanent and cannot be undone.

Right to refuse

You have the right to refuse this authorization. However, MamaCare360 requires this authorization to operate — without it, you will not be able to create an account or use the platform.

6.  DATA SECURITY

  • All data is encrypted in transit (TLS) and at rest (AES-256)
  • MamaCare360 is hosted on HIPAA-eligible AWS infrastructure
  • We maintain a signed Business Associate Agreement with Amazon Web Services
  • We do not store payment information
  • We will notify you within 30 days of discovering any breach affecting your data

7.  WHEN THIS AUTHORIZATION APPLIES

This authorization applies for as long as your MamaCare360 account is active, or until you revoke it in writing. It covers all health data you enter from the date you create your account.

By checking the HIPAA authorization box at sign-up, you confirm:

  • You have read and understood this authorization
  • You consent to MamaCare360 storing and processing your health information as described above
  • You understand that when you download or share your data outside MamaCare360, you are solely responsible for protecting it
  • You are 18 years of age or older, or a parent or legal guardian creating an account on behalf of a minor
